This Privacy Policy („Privacy Policy”) determines how XL Energy Marketing Sp..z. o. o. seated at Zlota street 59, 00-120 Warszawa, collects, process and uses information concerning Users.

All uppercase terms in this Privacy Policy have meanings assigned to them in the Regulations of e-sevices granted by XL Energy Marketing Sp. z o. o. (hereinafter referred to as “Regulations”) unless otherwise specified in a particular provision.

1. The Seller processes following data of the User: IP address of a device he uses while entering the Portal; type of internet browser, type of system software of the device of the User. This information is used in order to determine the number of visits of the Portal, average time the User uses the Portal or similar information. The Service Provider uses this information in order to improve the contents of the Portal.
2. If the User who is a natural person has placed an Order, the Seller – in addition to the data indicated in point. 1 – it also processes the following User data: name and surname, company name, address, e-mail address, payment card number (if payment is made for the order using a payment card), telephone number.
3. If the User has set up an Account on the Website, the Seller – in addition to the data indicated in point. 1 – it also processes the following User’s data: name and surname or company (if the User is a legal person or a defective legal person), e-mail address, address of residence or registered office, telephone number.
4. All information specified in items 1-3 will be jointly specified as “Personal Data”.
5. The Seller is the Controller of Personal Data (XL Energy Marketing sp. z o.o., ul. Złota 59, 00-120 Warszawa).
6. Personal Data are processed for purposes related to the Seller’s activities as part of an online store, including for the purpose of concluding and implementing sales and archiving agreements.
7. Personal Data are processed on the basis of the Regulations accepted by the User as part of setting up the User’s account or on the grounds of the justified interest of the administrator (eg defending against claims or ensuring the functioning of the website). The basis for processing User’s data, who did not open an account in the store, and placed an order is the implementation of the sales contract.
8. Providing Personal Data is voluntary, however, it may be necessary for the use of services or contract performance.
9. The recipients of personal data can be an authorized employees responsible for the service of Users and entities providing services to the Seller (eg accounting companies, IT services).
10. Personal data is stored for the period necessary for the execution of orders and keeping the User’s account in the online store. After this period, the data may be processed based on the legal obligations of the Seller (eg in the scope of storing accounting documents) or legally legitimate interest (defense against claims that may be due to the Seller).
11. The User has the right to access their Personal Data, to rectify, delete or transfer it, as well as the right to demand limitation of processing and object to such processing. In addition, in the scope of Data processed on the basis of consent, the User has the right to withdraw consent at any time. Each person whose Data is processed has also the right to file a complaint to the Data Protection Authorities.

13. Personal Data are processed by the Seller in accordance with the provisions of the Regulation on the Protection of Personal Data 2016/679 and national regulations on the protection of personal data and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219 with later changes) in the ICT system.
14. When processing Personal Data, the Seller uses software that protects them against unauthorized access, as well as against their loss and the operation of malicious software whose purpose is to gain access to them.
15. The Portal uses „cookies” files, i.e. small text files sent to the User’s computer during the use of the Portal. Information collected with the help of “cookies” allow adopting services and contents offered by the User as well as elaborating general statistics concerning the use of the Portal by the User. When the browser reconnects with the site, the site recognizes the type of device the User connects to. Parameters allow to read information contained in them only to the server that created them. Cookies therefore make it easier to use previously visited websites. The information collected relates to the IP address, type of browser used, language, type of operating system, Internet service provider, time and date information, location and information sent to the website via the contact form.
16. „Cookies” files, internet browser of the User may be recognized by the Portal. The majority of “cookies” used in the Portal is removed from the hard disc of the User’s computer (“session cookies”) after the session is completed by the User (i.e logging out on the User’s computer in order to allow recognizing the User’s computer during the next visit (“permanent cookies”).
17. „ Cookies identify the user, which allows the content of the website that he or she uses to be adapted to his or her needs. By remembering his or her preferences, cookies make it possible to match ads addressed to him or her. We use cookies to guarantee the highest standard of convenience of our service, and the collected data is used only by the Seller in order to optimize the activities.
18. In many cases, the software for viewing websites (internet browser) implicitly permits storing “cookies files” in the final device of the User. The Portal Users may any time change settings concerning “cookies files”. These settings may be changed especially in such a way to block automatic service of “cookies files” in the User’s device of the Portal.
